3. Photographic materials

1. Costa-holiday-rentals.com will make every effort to safeguard all materials supplied, and return them if required, but cannot be held responsible for any loss or damage, however caused, and for any loss or damage sustained.

7. Substitution of properties

1. An advertisement relates to a specific property. The property in an advertisement may not be substituted by another property.

8. Advertising more than one property on one advertisement

1. Each advertisement on the Costa-holiday-rentals.com site displays an individual property where people will spend their holidays - not examples of properties in a given area. Only one property can appear on each advertisement, unless it is a property with multiple rental units on the same site, and additional secondary advertising units are purchased. Costa-holiday-rentals.com reserves the right to amend the copy or remove the advertisement, when more than one property is described in the advertisement.

9. Termination of advertising

1. If advertisers wish to have their advertisement removed from the Internet before the end of their subscription period, this will be done, but no refunds will be paid.
2. Costa-holiday-rentals.com reserves the right to refuse any advertisement for Costa-holiday-rentals.com website, and will not be liable for any loss or expense in doing so.
3. If an advertiser attempts to enter unsuitable material into the Costa-holiday-rentals.com on-line database, or persistently misuses the on-line systems, Costa-holiday-rentals.com reserves the right to remove the property from the Costa-holiday-rentals.com site. No refunds will be paid.
4. If Costa-holiday-rentals.com receives a complaint from a person who has rented an advertiser's property which Costa-holiday-rentals.com, acting reasonably, consider is justified, or an advertiser knowingly double-books a property, or engages in any unacceptable practices or is in breach of its obligations to Costa-holiday-rentals.com, then Costa-holiday-rentals.com reserves the right to remove the property from the Costa-holiday-rentals.com web site without notice.

10. Authorization to Export Data

1. Advertiser acknowledges that in the sole discretion of Costa-holiday-rentals.com, it may be necessary to keep a copy of the advertiser content and information outside the Spanish and the European Union. If such a copy is made it will be used only in the day to day operations of Costa-holiday-rentals.com or its direct affiliates, and will not be shared with any third party.

11. Payment

1. Payment for advertising must be in Euros via PayPal by major credit and debit cards or a cheque drawn on a Spanish bank account.

12. IVA (Spanish Value Added Tax)

1. We are legally required to charge IVA at 16% to advertisers who are either resident in Spain; or private individuals resident in the EU.
2. If you are resident outside the EU, IVA will not be charged as our services are outside the scope of Spanish IVA when provided to you.
3. If you are an EU resident (except in Spain) and if you confirm that you are "In business", we will not charge you Spanish IVA
4. "In business", for this purpose, means that you rent property on a regular basis to generate income.

EU residents (except Spain)

1. By confirming you are "In business" you may be required to account for IVA in your local jurisdiction.
2. Residency is interpreted for IVA purposes as the country where the individual has set up home and is in employment.

13. Legal jurisdiction

These terms and conditions are governed by Spanish law and advertisers accept the exclusive jurisdiction of the Spanish courts to rule on any disputes.
